The conference will focus on the application of Dispute Boards, first-hand experience with new developments across the world, and the unique preventive role that Dispute Boards offer.

Driver Trett country manager Kobus Havemann, and Khamis Al Souli, our local partner, attended the opening of the Al-Batinah Expressway and were awarded a certificate of appreciation from the Ministry of Transport and Communications (MOTC) for their role as PMC on the project.

 

The Al-Batinah Expressway begins at the end of Muscat Expressway near the Halban intersection and ends at Khutmat Al-Milahah in Shinas, Oman, connecting the three governorates of Muscat, North Batinah and South Batinah.

The expressway, which is the largest road in the country to have been built by the Ministry, is expected to provide economic and social benefits to the Sultanate, accelerating urban development along the road and strengthening social bonds.

The completion of the project also supports the transport and logistics sector which is predicted to be a key sector for the regional and national economy.

The expressway consists of four lanes on each side with external and internal shoulders as well as 23 interchanges, 17 flyovers, 12 underpasses, 25 wadi bridges and 1,106 box culverts to ensure the smooth flow of traffic.

The developers took into account global technical safety standards and worked with regional and global expertise to complete the project.

Driver Trett was responsible for providing PMC services for the full length of the 270 km expressway, starting at the end of the Muscat Highway in Halban and ending at Khutmat Al-Milahah in the Wilayat of Shinas in the Governorate of North Al Batinah (packages number 1-6).

Project Management Award  Appreciation letter

Following many years of supporting clients and projects in Kuwait, April 12th marked the official launch of the Driver Trett Kuwait office.

 

The team welcomed around 100 guests at an informal meet and greet at the Sahara Golf Club. They were joined by Her Majesty’s Ambassador to the State of Kuwait, Mr. Michael Davenport MBE, who spoke about the strong links between the British and Kuwait governments for nearly 120 years, and Driver Group’s CEO, Gordon Wilkinson.

The opening of the office in Kuwait signifies Driver Trett’s commitment to the State of Kuwait and our dedication to serving the needs of the construction and engineering community. As we globally celebrate Driver Group’s 40th year, it is particularly pleasing to be opening new offices, so that we both celebrate the past, and look forward to the future.

Guests were invited to join the local team, and other members of the Driver Trett family from across the Middle East, to discuss the opportunities and challenges facing the construction industry in Kuwait and to celebrate the official launch of Driver Trett’s business in Kuwait.

Lee Barry recently spoke at the first ever Dispute Resolution Question Time event – hosted by Construction Week magazine in Dubai.

 

Lee was part of a panel made up of Charles Lilley from BLP, Jed Savager from Pinsent Masons and Rob Jackson from RICS and the sessions were moderated by Neil Hargreaves from Deloitte.

Imitating the format of the TV show ‘Question Time’ in the UK, panellists were asked questions directly from the audience and the event was live fed to Construction Week’s Facebook page. The common theme throughout the evening was the benefit of early intervention and attempting to resolve issues while relationships are still good.

Congratulations to the Driver Trett team in Oman for their work on the newly opened Muscat International Airport (MIA) which officially welcomed its first flight on 20th March 2018.

 

The new airport currently has a capacity of 20 million passengers per year, a number that will grow to 56 million passengers in the coming years.

With 59 aircraft parking spaces, the new airport is nearly double the size of the old airport and was developed for a total cost of $4.4bn (OMR1.7bn), according to Dr. Mohammed bin Nasser Al-Za’abi, chief executive officer of the Public Authority of Civil Aviation (PACA).

Driver Trett have been providing Contract and Procurement Management Consultancy Services to Oman Airports since September 2016 where our primary role has been to assist Oman Airports’ Procurement and Contracts department with the New Muscat International Airport.

Driver Trett was also appointed by the Ministry of Transport and Communications to provide commercial, claims, planning and dispute resolution support. This support has been delivered through the deployment of highly experienced and qualified personnel with expertise in the management and delivery of major commercial and infrastructure projects.

Octavian Dan, Technical Director at our London office will be providing a session at the FIDIC-ACEG Regional Infrastructure Conference on 6-7 March 2018 in Tbilisi, Georgia.

His session will be entitled ‘Delay Expert – 10 practical tips for making delay claims’ and will take place on the second day of the conference.

During this session, Octavian will provide a presentation that focuses on the reminder of the modified clauses in the FIDIC 2017 edition specifically related to time management, practical tips for preparing and working with programmes for delay claims, and identifying the appropriate delay analysis method in accordance with the overall content of the project.

On the 1st February 2018, Driver Trett hosted the annual Middle East golf day which took place at Jumeriah Golf Estates, Dubai – a world renowned golf course, famous for hosting the Race to Dubai championship.

The tournament took the format of a Texas Scramble which comprised of teams of 4 with one of the team members being a Driver Trett member of staff.

It was successful and enjoyable event with about 80 golfers on the course and over 120 attendees for the Awards Dinner in the evening, an opportunity for both golfers and non-golfers to socialise as well as congratulate the prize winners.

     

Christian Merrett will be delivering a CIOB CPD seminar on 'Delay Analysis Methodologies - Making the Right Choice' on 28th March 2018 at the Address Montgomerie, in Dubai.

 

Civil engineering, building and oil and gas industries are continually plagued by delays. Employers, Contractors and Subcontractors all have their opinions as to the best approach to assessing and determining their entitlement and/or culpability. However, this can sometimes lead them down a confusing and costly path with little to show for it. The industry is full of methodologies such as Collapsed As-Built, Impacted As-Planned and so on. After a while choosing and understanding the right approach can be confusing”!

Christian will attempt to explain and make sense of the various approaches to delay analysis and explain how the various differences in various situations will call for the different approaches in carrying out the right delay analysis.

Lee Barry, Regional Managing Director for the Middle East and Africa will be hosting a half day workshop on claims and disputes in conjunction with HFW as part of the FIDIC Middle East Conference in Dubai on Feb 19th 2018.

A DAB HAND…DISPUTE RESOLUTION UNDER NEC4

The Contractor has reached the final stages of the fit out of the Ritz Krakhaa Hotel. The project is close to completion, and yet the parties are far apart on various elements of the account. On the 21st November 2017, Driver Trett and the Hong Kong International Arbitration Centre (HKIAC) co-hosted an evening's discussion about what to expect from the changes.

Dr. John Lancaster will address the Society of Construction Law Australia's National Conference about the potential role of Artificial Intelligence in the minimisation and mitigation of project delay.

 

John has completed a PhD in aspects of Artificial Intelligence related to Project Schedule Optimisation utilising Genetic Algorithms.  He has been widely published on this topic and has supervised other research students on related topics.

Shane O’Regan is an Associate Director with Driver Trett and is based in the Doha office. He is an internationally experienced Chartered Quantity Surveyor with over 15 years’ experience in the construction industry. He has worked on projects in Qatar, Kuwait, United Kingdom and Ireland. He holds a Master’s degree in Construction Law and Dispute Resolution from King’s College London, and is a Member of the Chartered Institute of Arbitrators. He is also a Member of the Royal Institution of Chartered Surveyors and the Society of Chartered Surveyors Ireland.

He has excellent knowledge of a broad range of contracts and construction law issues relating to arbitration, adjudication and litigation. Shane has undertaken claims management involving complex contractual claims on large projects on behalf of clients, main contractors and subcontractors, and has considerable experience in delay analysis and dispute resolution.

Mark Stevenson, one of Driver Trett’s Technical Directors who is based in Bristol, was the featured speaker at the South West Chartered ICES AGM on Tuesday 21st March 2017. He spoke on the topic of impacts of emerging case law on construction contracts which covered recent changes relating to enforcement of smash and grab adjudication decisions, interim payment processes, and concurrent delay.

There was a good turnout to the event with standing room only at the back of the room and attendees including Bill Pryke – Chartered ICES CEO, Harry Bell – Chartered ICES President, and Mark Phillips – South West Chairman. The talk was well received by the audience with some engaging audience participation and interesting questions.

On the 9th February 2017, Driver Trett hosted the annual Middle East golf day which took place at Jumeriah Golf Estates, Dubai – a world renowned golf course, famous for hosting the Race to Dubai championship.

The tournament took the format of a Texas Scramble which comprised of teams of 4 with one of the team members being a Driver Trett member of staff.

It was successful and enjoyable event with 77 golfers on the course and over 120 attendees for the Awards Dinner in the evening, an opportunity for both golfers and non-golfers to socialise as well as congratulate the prize winners.

On December 19th Ali Fard, the Director of Driver Trett Canada, will be delivering a presentation entitled “Before The Claim: Mid-Project Dispute Resolution for a (Potentially) Post-Adversarial World” at the Canadian Bar Association in Calgary.

The event is aimed at construction law practitioners, both external and in-house counsel, and his presentation will focus on mid-project dispute resolution:  the use of third party neutrals/technical experts/project referees, on the non-legal side, who work with owners and contractors who are in a claim situation to resolve problems while the project is ongoing in order to prevent disputes from being escalated.

Project Controls Expo is the largest international project control event featuring expert international speakers presenting masterclasses and a job fair for attendees. It took place at the Emirates Stadium on Wednesday 16th November 2016 and provides a platform for delegates to meet new people, listen to some engaging presentations from peers and network in a fantastic venue.

Mark Wheeler, our Global Chief Operating Officer, also delivered an interesting and informative presentation entitled “Challenges with Change” which received positive feedback from delegates.

The autumn 2016 series of Driver Trett Seminars is now over with sessions delivered to clients and key contacts. PROGRESS, POSITION, PREDICTION – THE KEY TO COMPLETING PROJECTS ON TIME – DAVID BORDOLI

The 75th Annual Conference of the African Forum of Civil Engineering Contractors (SAFCEC) was held this year, on 11 November, at the Sandton Convention Centre in Johannesburg. David Bordoli of Driver Group Africa was one of the presenters to the audience of over 200 influential engineering professionals. Driver was also represented by Christo de Witt at the conference.

David’s presentation, titled ‘Prediction is very difficult, especially if it’s about the future’, a quote borrowed from physics Nobel Laureate Nils Bohr was not about nuclear fission but about a new method he had developed to predict project completion if no action was taken to change negative trends. The new method is easier to understand and compute than existing ‘earned value’ methods, leading to greater understanding by the whole of the team of the effects of trends and the need for change to ensure timely project completion.

DIALES, the construction expert witness support service provided by Driver Group, is delighted to announce the launch of our searchable expert witness app.  Now available to download on the App Store for iPhone and iPad, the DIALES app provides quick and easy access to global quantum, delay analysis, and technical experts.

Users can search the expert database by keyword for a precision search, or use the simple filters to narrow expert pool to reflect the required expertise, experience, and regional knowledge required.

Once the ideal expert is identified, users can email them directly, review their experience highlights, and read or email a full PDF profile.  For those looking for more broad advice or discussion, users can easily identify their local office through an interactive map, or simply send an enquiry email.

The app also streams the latest news and articles from DIALES, keeping users up to date with new expert appointments or insight from our internationally published team.

We are pleased to announce that Garth McComb, General Manager of Driver Trett’s Kuala Lumpur Office, has been empanelled with the Kuala Lumpur Regional Centre for Arbitration (KLRCA) as an Adjudicator.

In addition, Mr Lim Eng Kok, Associate Director of Driver Trett’s KL office has passed the KLRCA adjudication training programme and is expected to be empanelled with KLRCA soon.

Both Garth McComb and Lim Eng Kok are available for appointments as Adjudicator under the Malaysian Construction Industry Payment and Adjudication Act 2012 which came into force on 15 April 2014.

Driver Group, the global construction consultancy, has had a growth fuelled year since the acquisition of Trett Consulting and the re branding of its expert witness service, DIALES, in 2012.

The consultancy has almost doubled in size, in terms of revenues, employee numbers, and new offices and can now offer unrivalled client support to the engineering and construction industries around the globe.

The last month saw acquisitions of certain assets of PJ Consulting Ltd in Hong Kong and the opening of an office headed up by Peter Ho. This added to the Group’s Asia Pacific network, which also saw new offices open in Brisbane and Perth in 2013. number of expert guests from the construction industry well exceeded our expectations with over 100 participants on the night. The seminar explored the use of Expert witnesses in Construction Disputes.
